§ 1 User

§ 2 Scope of application
These General Terms and Conditions apply to all legal transactions between the user and a consumer (according to § 13 of the German Civil Code, a "natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to his commercial nor to his independent professional activity").

§ 3 Conclusion of the contract and storage of the contract text
The provisions of these GTC apply to orders which consumers conclude via the website www.belvabones.com of the online shop Belva Bones.

The contract is concluded with the user (see § 1).

The presentation and description of the goods on the website of the shop www.belvabones.com does not constitute a contract offer.

By ordering goods by clicking on the "Buy Now" button at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is not concluded until the user sends an order confirmation by e-mail.

The text of the contract is stored for orders. Consumers receive an e-mail with the order data and the applicable GTC. After conclusion of the contract, the order data can no longer be viewed online.

§ 4 Payment
Shipping costs are not included in the displayed price and may be charged additionally.
The following payment options are available to consumers:

  • Bank transfer
  • Credit card


§ 5 Delivery, delivery restrictions
Unless the description of a selected product explicitly states otherwise, delivery shall be made within 5 working days.
In the case of payment via bank transfer or Paypal, this period begins to run on the day after the payment order is issued.

§ 6 Transfer of risk
The risk of accidental deterioration or accidental loss of the goods shall remain with the user until the goods are handed over and shall pass to the consumer upon handover.

§ 7 Retention of title
The user retains ownership of the goods until the purchase price has been received in full.

§ 8 Warranty

The statutory warranty regulations apply.

§ 9 Return/Exchange

Since the goods offered in the shop www.belvabones.com are handmade art objects, any exchange or return is excluded.

§ 10 Dispatch

Shipment is exclusively insured and can be subsequently insured by Post.at, which is liable for any loss or damage.

§ 2 Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Rechtsgeschäfte zwischen dem Verwender und einem Verbraucher (Gemäß § 13 BGB einer „natürlichen Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können“).

§ 3 Vertragsschluss und Speicherung des Vertragstextes
Die Bestimmungen dieser AGB gelten für Bestellungen, welche Verbraucher über die Website www.belvabones.com des Onlineshops Belva Bones abschließen.

Der Vertrag kommt mit dem Verwender (siehe § 1) zustande.

Die Vorstellung und Beschreibung der Waren auf der Internetseite des Shops www.belvabones.com stellt kein Vertragsangebot dar.

Mit der Bestellung einer Ware durch einen Klick auf den Button „Buy Now“ am Ende des Bestellvorgangs gibt ein Verbraucher ein verbindliches Angebot auf einen Kaufvertragsabschluss ab. Erst mit dem Versand einer Auftragsbestätigung per E-Mail durch den Verwender kommt der Vertragsschluss zustande.

Der Vertragstext wird bei Bestellungen gespeichert. Verbraucher erhalten eine E-Mail mit den Bestelldaten und den geltenden AGB. Nach Vertragsschluss sind die Bestelldaten nicht mehr online einsehbar.

§ 4 Zahlung
 Versandkosten sind nicht im angezeigten Preis enthalten und können ggf. zusätzlich anfallen.
Verbrauchern stehen folgende Zahlungsoptionen zur Verfügung:

  • Paypal
  • Überweisung
  • Kreditkarte


§ 5 Lieferung, Lieferungsbeschränkungen
Die Lieferung erfolgt – sofern die Beschreibung eines gewählten Produkts nicht explizit Abweichendes festlegt – innerhalb von 5 Werktagen.
Diese Frist beginnt im Falle der Zahlung via Überweisung oder Paypal am Tag nach Erteilung des Zahlungsauftrages zu laufen.

§ 6 Gefahrenübergang
Das Risiko einer zufälligen Verschlechterung oder einem zufälligen Verlust der Ware liegt bis zur Übergabe der Ware beim Verwender und geht es mit der Übergabe auf den Verbraucher über.

§ 7 Eigentumsvorbehalt
Bis zum vollständigen Empfang des Kaufpreises behält sich der Verwender das Eigentum an der Ware vor.

§ 8 Gewährleistung
Die gesetzlichen Gewährleistungsregelungen gelten.

§ 9 Rückgabe/Umtausch

Da es sich bei der angebotenen Ware im Shop www.belvabones.com um hangefertigte Kunstobjekte handelt, wird jeglicher Umtausch und jegliche Rückgabe ausgeschlossen.

§ 10 Versand

Der Versand erfogt ausschließlich versichert und nachvervolgbar durch Post.at, welche für eventuelle Verluste und Beschädigungen haftet.

Le presenti Condizioni Generali si applicano a tutti i negozi giuridici tra l'utente e un consumatore (ai sensi del § 13 del Codice Civile austriaco, una "persona fisica che conclude un negozio giuridico per scopi che non possono essere prevalentemente attribuiti né alla sua attività commerciale né alla sua attività professionale indipendente").

§ 3 Conclusione del contratto e conservazione del testo contrattuale
Le disposizioni delle presenti CG si applicano agli ordini che i consumatori concludono attraverso il sito web www.belvabones.com del negozio online Belva Bones.

Il contratto viene stipulato con l'utente (cfr. § 1).

La presentazione e la descrizione della merce sul sito web del negozio www.belvabones.com non costituiscono un'offerta contrattuale.

Ordinando la merce cliccando sul pulsante "Buy Now" alla fine del processo di ordinazione, il consumatore fa un'offerta vincolante per concludere un contratto di acquisto. Il contratto non è concluso finché l'utente non invia una conferma d'ordine via e-mail.

Il testo del contratto viene memorizzato per gli ordini. I consumatori ricevono un'e-mail con i dati dell'ordine e le CGC applicabili. Dopo la conclusione del contratto, i dati dell'ordine non possono più essere visualizzati online.

§ 4 Pagamento
Le spese di spedizione non sono incluse nel prezzo esposto e possono essere addebitate in aggiunta.
I consumatori possono scegliere tra le seguenti opzioni di pagamento:

§ 5 Consegna, restrizioni alla consegna
A meno che la descrizione di un prodotto selezionato non indichi esplicitamente il contrario, la consegna avverrà entro 5 giorni lavorativi.
In caso di pagamento tramite bonifico bancario o Paypal, tale termine decorre dal giorno successivo all'emissione dell'ordine di pagamento.

§ 6 Trasferimento del rischio
Il rischio di deterioramento accidentale o di perdita accidentale dei beni rimane a carico dell'utente fino alla consegna dei beni e passa al consumatore al momento della consegna.

§ 7 Riserva di proprietà
L'utente conserva la proprietà della merce fino al completo ricevimento del prezzo di acquisto.

§ 8 Garanzia
Si applicano le norme di garanzia previste dalla legge.

§ 9 Restituzione/Cambio

Poiché la merce offerta nel negozio www.belvabones.com è costituita da oggetti d'arte fatti a mano, è escluso qualsiasi cambio o restituzione.

§ 10 Spedizione

La spedizione avviene esclusivamente assicurata e tracciabile da Post.at, che risponde di eventuali perdite o danni.
